Guest stays without remuneration by the TU Dresden
Important for:
Visiting scientists, non-EU foreign country, in particular:
- Visiting professors, non-EU foreign countries (without employment contract, residence permit)
- Doctoral students, non-EU foreign countries (without employment contract, residence title)
- Scholarship holders, non-EU countries (without employment contract, residence title)
- Doctoral students, non-EU countries (without employment contract, residence title)
The following points refer to agreements on guest stays of visiting scholars from non-EU countries at the TU Dresden. They are to be observed if:
- no employment contract relations are entered into between these persons and the TUD and
- they finance their stay in Dresden from their own funds or through scholarships.

For doctoral students without enrollment (and without an employment contract with the TU Dresden) and Stipentiat:innen the „Vertrag über einen Gastaufenthalt“ has to be used. The "Contract for a Guest Stay" cannot be used if the guest student wants to finance his/her stay with his/her own income. In this case, a "Hosting Agreement - Contract on the Granting of a Residence Permit according to § 18d AufenthG" must be concluded. |
For doctoral students, visiting professors (without an employment contract with TU Dresden), scholarship holders of the visiting scientist programs, the "Hosting Agreement - Contract on the Granting of a Residence Permit according to § 18d AufenthG" has to be used - provided that the person has monthly means of subsistence at least equal to the unemployment benefit II (standard rate of 449 €/month plus rent and health insurance costs, if applicable). |
Guest applications for students and scientists
The following general sequence of steps for guest applications for students and researchers should be followed:
- The supervising university lecturers fill out the "Vertrag über einen Gastaufenthalt" or the "Aufnahmevereinbarung. Vertrag zur Erteilung der Aufenthaltserlaubnis nach § 18d Aufenthaltsgesetz".
- Subsequently, the completed document is signed by the supervising university teacher and the visiting scholar.
- The signed document is preferably sent digitally (or in printed form by internal mail) to the International Affairs Officer of the GSW Department.
- After review by the responsible International Affairs Officer, the signed contract or hosting agreement will be sent to the visiting scholar.
Guest applications for scientists:inside as an invitation for a visa
If the contract and hosting agreement are already used as an invitation for the visa application before the guest scientist from a non-EU country enters Germany, please note the following:
- The supervising university lecturers are asked to fill in the corresponding document (see above), sign it and forward it to the responsible International Affairs Officer.
- The latter will send the form to the guest or to the relevant International Office after checking it. The contract or hosting agreement thus replaces a frequently requested informal letter of invitation from the supervising university professor.
- However, both documents must be submitted to the Foreigners' Registration Office in addition to the scholarship contracts of the TU Dresden.
Guest stays for an activity with remuneration
(or other (financial) remuneration by the TUD)
Even in the case of independent work on a fee basis or for expense allowance, the Human Resources Department is responsible for concluding the hosting agreements and, if necessary, other contracts.
The Human Resources Department is responsible for concluding contracts that provide for financial compensation or other monetary benefits (in particular employment and service contracts, contracts for work and fees, and other agreements in return for remuneration).
If a hosting agreement is to be concluded with the visiting scientist from a non-EU country (i.e. professor, doctoral candidate, PhD, scholarship holder, residence title) in these cases, the employment office is requested to send the completed form for the hosting agreement electronically to the Human Resources Department for review and signature in addition to the usual application/hiring documents.
In general (for both paid and unpaid contractual relationships):
A hosting agreement can only be concluded if the person explicitly wishes to apply for a residence title according to § 18d AufenthG for research purposes. If another right of residence is sought (e.g. according to § 16b AufenthG for study purposes or according to § 21 AufenthG for self-employed activities), different requirements apply in each case.
