The growing number of legal norms which prescribe implementation ‚by design’ (e.g. in privacy and data protection, Art. 25 GDPR) requires a closer look at the very process of design. Throughout the design process, legitimate normative claims are translated into AI-based systems. While such systems thus increasingly impact the execution of legal norms considerably and thereby fulfill a central role in the legal system, the design process requires proper conceptualization as it constitutes a central link between the normative and the technical levels with the crucial function to mediate legitimacy. The project seeks to explore the constitutional, procedural and democratic requirements that shape (or should shape) the design process of AI-based systems in order to assure a responsible use of AI in the legal realm.
