Abstract:
This paper examines the introduction of the Substitute Building Materials Ordinance with regard to its influence on the construction industry. The aim of the Substitute Building Materials Ordinance is to promote the circular economy, to eliminate the legal uncertainties that have existed for years and to standardise the federal state-specific regulations in order to increase the acceptance and use of mineral substitute building materials. After the presentation of the Substitute Building Materials Ordinance, the critical points of the stakeholders involved and the origin of the limit values are analysed. After analysing the limit values, the connection to other legal and sublegal limit values is shown. On this basis, it is then examined which substitute building materials are restricted in their use by the introduction of the Substitute Building Materials Ordinance and which materials can be used to counteract the omission. In order to be able to evaluate the material flow shifts resulting from the restrictions, the current material flows are presented. The material flow shifts lead to more material being landfilled. For this reason, the landfill space required in the future is compared with the landfill space currently available.
