Abstract:
The thesis is dedicated to the challenges of construction site noise, which can significantly affect both the health of employees and the quality of life of neighbouring residents. The current legal situation is comprehensively analysed. Protection against hearing damage is a top priority in occupational health and safety, as noise is one of the most common causes of occupational illnesses. The LärmVibrationsArbSchV serves as the central regulation. In terms of immission control law, construction noise harbours an increased potential for conflict, especially in inner-city areas. The BImSchG forms the legal basis, while the AVV Baulärm contains specific regulations on construction site noise. However, the ordinance has potential for optimisation with regard to extraneous noise and peak levels. Under civil law, those affected can assert claims for compensation and rent reduction on the basis of the German Civil Code (BGB), with the AVV Baulärm serving as a benchmark. The paper is based on current case law and recommends a revision of the AVV Baulärm in order to adequately meet the current challenges.
