§ 1 Scope of application of the general terms and conditions
These general terms and conditions apply to the entire range of sports courses offered by the Dresden University Sports Center (hereinafter referred to as DHSZ), regardless of whether they are conducted under the responsibility of the DHSZ or arranged by it.
The university sports program is primarily aimed at students and staff of the Dresden universities listed under § 2 (1) of these general terms and conditions and is subject to a fee.
§ 2 Eligibility
(1) Participation is open to all students and employees
- of TU Dresden
- of HTW Dresden
- of the University of Fine Arts Dresden
- of the Carl Maria von Weber College of Music Dresden
You must be registered in a sports course and have paid the fee for the respective booking period. If capacity is limited, students will be given priority to attend.
Minors attending the university must provide the DHSZ with a consent from their legal guardian and a current certificate of enrollment at the university.
(2) In special cases, family members of the university members as well as other interested parties may also take advantage of the DHSZ offer provided that they are of age, online booking is possible, and the corresponding fee has been paid.
§ 3 Booking
(1) Participating in the sports courses of TU Dresden's DHSZ requires prior online booking. You can book via http://www.dhsz.tu-dresden.de/ or via www.tu-dresden.de/dhsz.
(2) If a course has free places available, booking is possible throughout the semester.
(3) If you wish to participate in sports during the semester break, but did not book a course during the lecture period of the current semester, you must purchase a ticket for the semester break (under letter T - Ticket for the semester break).

§ 4 Conclusion of contract
(1) The services of the DHSZ are detailed in particular on the internet. When booking online, an offer is made to conclude a contract.
(2) By booking, you accept the general terms and conditions and take note of the general and sport-specific instructions.
(3) Insofar as the desired course can still be booked, a booking confirmation will be displayed for printing immediately after the booking. If you have provided an email address during the booking process, the booking confirmation will also be sent by email.
(4) By confirming the booking, the DHSZ accepts the offer to conclude the contract. Upon receipt of the booking confirmation, the contract between the DHSZ and the participant is concluded.
(5) The booking confirmation includes:
- the ticket for participation,
- the account details for the transfer of the fee, and
- specific information about the chosen course (course start, location, etc.)
(6) The participation ticket must be brought to every course session. After payment has been received, the course instructor will affix a token to it, which will serve as proof of payment of the fee.
(7) The participation ticket with the token serves as an access permit to the sports facilities and as proof of course membership. It is only valid in conjunction with the student ID (for students) or with a photo ID (for non-students) and is thus personal and course-specific, as well as non-transferable. In the case of applicable insurance coverage (§ 9), it also serves as proof of insurance coverage.
§ 5 Fees
(1) Participation in DHSZ sports is subject to a fee for each course.
(2) The fees are used exclusively to ensure the continuation of high-quality sports activities at the DHSZ. The amount of the individual fees depends on the material and personnel costs of the respective sport. Students and employees pay different fees. External participants pay a higher fee, if they are able to participate. The fees are subject to the University Fee and Charge Regulations (Hochschulgebühren- und Entgeltordnung), dated June 21, 2016, as amended July 17, 2019.
(3) Irrespective of the time of the online booking, the fee remains the same throughout the semester. This applies even if the booking is made shortly before the end of the course.
(4) Payment is made by active bank transfer. The transfer must be made within a period of 3 calendar days after the conclusion of the contract (receipt of the booking confirmation, § 4 para. 3). In case of rebooking (§ 6 par. 4) to a higher fee category, the difference between the fee already paid and the new (higher) fee must be paid within 3 calendar days after receipt of the (re)booking confirmation.
§ 6 Termination, rebooking
(1) With the exception of compact courses (courses that end after one week at the latest), you can cancel your participation in the booked course at any time without giving reasons. For compact courses, the termination must be received by the DHSZ no later than 1 week prior to the start of the course. The termination must be made in writing, either via the link in the booking confirmation received by email (§ 4 para. 2 sentence 2), by email to the person responsible for the type of sport or to .
(2) If the fee is not paid or not paid on time (§ 5 para. 4), the DHSZ shall be entitled to terminate the contract.
(3) The DHSZ is also entitled to terminate the contract if the participant is absent from two consecutive course sessions without giving notice.
(4) Rebooking, i.e. a change from an already booked course to another course, represents the termination of the previous course and at the same time an offer to conclude a new contract. The DHSZ is not obligated to accept the new offer. With the exception of para. 5, rebooking can only be made within one week of the official start of the intended course. Provided that the aforementioned deadline is met and the capacity of the intended course allows for it, a booking confirmation for participation in the rebooked course will be sent by email.
(5) If there are too few registrations for an advertised course, the DHSZ reserves the right to completely withdraw this course from the program. In this case, participants have the right to rebook or, alternatively, to request a refund of the fee they have paid (for the refund form, see § 7 para. 3).
§ 7 Refunding of fees
(1) In the following cases, you are not entitled to request a refund of the fee:
a) Termination of the contract by the participant after the start of the course, except in the case of illness or injury (para. 2 c)
b) Termination by the DHSZ due to non-payment or late payment (§ 6 para. 2)
c) Termination by the DHSZ due to multiple absences without prior notice (§ 6 para. 3)
d) Termination by the DHSZ according to § 8 para. 2
(2) In the following cases, you may request a refund of the fee:
a) Withdrawal of the course from the program, e.g. due to insufficient registration (§ 6 para. 5)
b) Termination by the participant, which is received by the DHSZ before the start of the course (§ 6 para. 1)
c) Termination by the participant due to illness and/or injury, if proof can be provided (medical certificate) and the application for reimbursement is received by the DHSZ in due form and time. The deadline is met if the DHSZ receives the application within 4 weeks of the official start of the course. In the event of termination in due form and time, the fee will only be refunded on a pro rata basis.
(3) To request reimbursement of fees, you must use the form Reimbursement of sports fees. The application must be sent to or submitted in written form to the DHSZ. Note: The form can be signed digitally (open it in Acrobat Reader).
(4) In the event of rebooking (§ 6 para. 4) from a higher to a lower fee category, the new contract comes into effect with the proviso that the higher fee is owed for the new course. Thus, no reimbursement will be made.
(5) A fee will only be reimbursed if it exceeds 10 EUR.
§ 8 Inspections, attempted fraud
(1) All course instructors, designated ticket inspectors, and DHSZ staff are authorized to view the participation ticket with a student ID / photo ID and proof of payment of the fee (token). Upon request, the aforementioned documents must be presented for inspection.
(2) Termination of the contract and exclusion from university sports may be caused by:
- Unauthorized use of the participation ticket
- Participation in DHSZ sports without payment
- Unauthorized use of a password during registration
- Deliberate manipulation of the registration
- Failure to comply with the instructions of sports managers, course instructors, inspectors or staff in the sports facilities
- Failure to comply with the Sports facility regulations, the General instruction for participants in university sports or the Sport type specific regulations
- Suspicion of a violation of applicable law, in particular theft, bodily harm or sexual harassment against participants, management and organizational staff
§ 9 Insurance cover
(1) In the event of a sports accident, students of the universities listed under § 2 (1) are insured if certain requirements are met. This is the case if
- the sporting activity takes place within the framework of a sports course advertised and run by the DHSZ, and
- proof of a valid course booking for the current semester can be provided.
(2) The insurance cover includes commuting accidents - in accordance with the regulations applicable to this (Unfallkasse Sachsen).
(3) The insurance cover also applies to training courses, seminars, competitions, etc. which are organized by the DHSZ or to which the DHSZ sends participants.
(4) For employees, a sports accident may be considered an occupational accident and accident insurance may be provided by the Saxon Accident Insurance Fund (Unfallkasse Sachsen) if the criteria of a sporting activity in the context of a company sport are met. These are met when the sporting activity
- provides compensation for job-related physical and mental stress,
- is oriented towards mass sports (no pure participation in competitions), and
- is limited to employees and related to the university.
(5) Not covered are:
- Events for which the DHSZ provides sports facilities for use, but does not organize or conduct these itself.
- Civil servants employed at TU Dresden, the University of Fine Arts Dresden, and the Carl Maria von Weber College of Music Dresden. For these individuals, sports accidents in the context of university sports are not considered work-related accidents.
- All external participants and students from higher education institutions other than those listed above.
- Courses outside the designated sports facility / location.
§ 10 Accident report
(1) A sports accident must be reported immediately to the course instructor, the person responsible for the type of sport or to the DHSZ administration, Chemnitzer Straße 48a, Tel. +49 351 463 33778 as well as to the institute of higher education where the participant is enrolled.
(2) Irrespective of immediate notification, the accident must be reported in writing. Students complete the corresponding Accident report form for children in day care facilities, pupils, students. TU employees complete the designated Accident report form. Accident reports may also be emailed to the DHSZ administration () for initial information, but must be submitted in original afterwards.
§ 11 Liability
(1) The universities shall only be liable for their employees and agents towards third parties within the scope of the law.
(2) The DHSZ makes liability insurance available for the assigned course instructors during their activities.
§ 12 Theft
(1) No liability will be assumed in the event of material losses in the sports facilities used by the DHSZ. We therefore strongly recommend locking up valuables if possible or not bringing any valuables at all. In the event of loss, we recommend filing a criminal complaint with the police.
§ 13 Problems
(1) Should you have any problems concerning university sports, the DHSZ staff, the DHSZ management and the student representatives (course instructor representative, sports advisor) are available as contact persons at any time.
§ 14 Data protection
(1) Participation in university sports is optional. Thus, the disclosure of personal information to the DHSZ during online booking is also voluntary. If you decide to participate in DHSZ sports, you must register online with some personal data (last name, first name, address, status, enrollment number for students, mail, birthday, gender). All personal data collected in this context will be used exclusively for the purpose of course administration at the DHSZ. No data will be transferred to third parties.
(2) By participating in our registration system, you consent to a corresponding storing of the above-mentioned personal data for a period of two years. You can revoke your consent at any time.
(3) All personal data the DHSZ needs to process is subject to the regulations of data protection. The DHSZ online booking is based on the principles of the Saxon Data Protection Act (SächsDSG). We assure you that we have taken all technical and organizational measures to effectively comply with these provisions. Compliance with this law is subject to review by TU Dresden's Data Protection Officer.
(4) The DHSZ is informed via secure data transmission (not online) by the main treasury of the Free State of Saxony (Hauptkasse des Freistaates Sachsen) about the payment and accounting of the fees.
(5) The DHSZ occasionally uses its sports courses to take photos of participants during sports in order to publish them on the homepage www.tu-dresden.de/dhsz. By booking a course in the booking system und participating at this course, you consent to the taking and publication of such photos. You can revoke this consent in writing at any time. In order to do so, please contact the DHSZ administration.

§ 15 Instructions
(1) The general instruction for university sports participants and the sport type specific instructions are published on the DHSZ homepage under Info / Instructions. By booking, you acknowledge and agree to comply with them.
§ 16
According to the current Saxon Corona Protection Ordinance, there are no longer any restrictions on sport. Nevertheless, we recommend taking into account the information in the Corona Protection Ordinance of the TU Dresden (but not mandatory for sport) and implementing a health-care cooperation in sport.
