GRUR International 1/2026 published the article by JProf. Dr. Kaesling, Wiss. Mit. Simon Deutsch and Wiss. Annegret Wolf on "'Freedom to Repair' under Trade Mark and Patent Law - A More Ecological Approach to Industrial Property Rights?" was published.
Against the background of the "Goods Repair Directive", the authors examine the limits placed on the right to repair by industrial property laws. Challenges and obstacles to the "freedom to repair" are identified in relation to both areas of law, with a focus on the European Union trademark and the unitary patent, and conclusions are drawn on a more sustainability-focused approach to the repair of goods under the current legal situation.
