EJIL: Talk! - (Not) Investigating Kunduz and (Not) Judging in Strasbourg? Extraterritoriality, Attribution and the Duty to Investigate
In the run-up to the hearing before the Great Chamber of the European Court of Human Rights (ECHR) tomorrow on February, 26 in Hanan v. Germany, Prof. Steiger has published a post on EJIL: Talk! which can be accessed via this link.
In the process, the ECHR is to examine whether the Federal Republic of Germany violated its duty to investigate with respect to air strikes near Kunduz (Afghanistan) which was orchestrated by a German commander and cost more than 100 people's lives. Prof Steiger argues in his post that the Court should decide in favor of the claimant in order to both bring justice to the victims of the air strikes and to reinforce human rights protection in armed conflict far from European soil.
