Constitutions as the highest norms of a political order appear to us today as everyday institutions. Historically, however, they are relatively young, as they are considered to be an invention of the revolutions in France and the USA. Theoretically, they raise the question of how political power can be bound by rules that it has set itself. Are constitutions legal or political norms? Do authoritarian orders have a constitution? Who legitimately controls the provisions of a constitution? Do constitutions exist outside of state orders? This volume presents the debates on these questions in a systematic-historical approach that not only deals with canonized authors from Emmanuel Joseph Sieyès to Hans Kelsen, but also takes up the global diversity of the debate on constitutional theory.
