Lecture: Theory and development of the constitutional state
(PHIL-PV-THEO-1 I THEO-GK I POL-WISS-WSK I MA-IB-TDE I BA-IB-EF)
Prof. Dr. Sabine Müller-Mall
Wednesday (3) 11:10-12:40, ASB/0028/H
The lecture deals with the concept of the constitution as well as the historical, theoretical and legal foundations of modern constitutionalism. Following an overview of the historical foundations of the modern constitutional state and selected theories, an informed examination of the current challenges facing modern constitutionalism will be undertaken along the lines of theory formation, controversies and lines of conflict. In this way, discourses on state and constitutional theory can be placed in the respective historical circumstances and an idea of how preconditional democratic constitutionalism is can be acquired.
A reading seminar is offered to accompany the lecture. Participation in both courses is a prerequisite for the acquisition of credits in the Master's program "Politics and the Constitution".

Lecture seminar: Theory and development of the constitutional state
(PHIL-PV-THEO-1 I THEO-GK)
Prof. Dr. Sabine Müller-Mall
Wednesday (5) 14:50-16:20
The reading seminar accompanies the lecture "Theory and Development of the Constitutional State". It offers an overview of important historical and contemporary problems of constitutional thinking. Based on the founding contexts of the modern constitutional state in America, France and Germany, the first part of the seminar will examine the historical foundations of constitutionalism. The second part will then focus on systematic-theoretical considerations on concepts and problems of constitutional thinking, which will be examined on the basis of texts from international constitutional theory. Finally, the third part will focus on current conflicts in constitutional theory, such as the role of the judiciary in the institutional structure of modern constitutional states or the opportunities and risks of global constitutionalism. Participation in the reading seminar requires thorough preparation of the texts to be discussed (also in English) and a willingness to actively participate.
