Abstract:
This paper examines the effects of existing minimum requirements of workplace law with regard to the usability of structural facilities. After a basic introduction to the subject of the legal situation at national and European level, the relevant regulations are discussed. The fulfilment of the requirements for workplaces beyond what is necessary is analysed and placed in the context of other regulations with a focus on the effects on employees with disabilities. A barrier-free design of the workplace is to be evaluated in various aspects with regard to the meaningfulness of fulfilling the requirements beyond the necessary level. In addition to comparisons of the regulations at federal and state level, these are also considered in relation to the legal situation of the European Union. In particular, the requirements of the Workplace Ordinance with its concretising workplace regulations and other technical regulations are examined in detail. The basic features of these are explained, compared in detail and examined with regard to emerging differences. For reasons of limited scope, the study only looks at individual components of workplaces and places them in the respective context of the Workplace Ordinance and the technical regulations. Thus, in the course of the in-depth considerations, only requirements for room dimensions, safety and health markings, doors and gates and escape routes are examined in more detail. By means of a practical example, the insights gained are to be presented clearly with reference to a current building project and explained in more detail.
