Abstract:
This paper analyzes the basis for claims that allow price adjustments due to an extension of construction time, changes in quantity with unchanged performance and increases in material prices. The nations of Germany, Norway and Sweden have requirements for price adjustments as a result of an extension of the construction period, although there are differences between the Scandinavian nations and Germany due to a different legal structure. Furthermore, price adjustments due to a change in quantity are possible in all nations, whereby Germany is based on a quantity-related limit and Norway on a monetary limit. It has been demonstrated that the legal requirements and "force-majeure regulations" for price adjustment as a result of a material price increase do not provide a reliable basis for claims, which is why contractual regulations for index-based price adjustment must be used. In Germany, the price adjustment is calculated on the basis of the material, while Norway and Sweden use general, building-related indices. The imputed comparison shows that these do not provide sufficient compensation because material-specific price increases are not reflected realistically by general indices. A combined variant with general and specific indices would be an optimal way of capturing cost and material price increases in their entirety.
