Abstract:
This thesis analyses the effects of the entry into force of the Substitute Building Materials Ordinance on the construction industry. On the one hand, it aims to promote the circular economy in the construction sector and therefore achieve high recycling rates and increase the acceptance of secondary raw materials. At the same time, however, the ordinance protects the environment and nature as well as people from hazardous pollutant inputs into the soil and groundwater through stricter limit values and scientifically based analysis methods for the mineral waste falling within the scope of application.
After a theoretical categorisation of the topic, including some terminology and the legal framework of the regulation, the stakeholders involved are presented. Expert interviews are conducted so that the cooperation between the individual stakeholders during the legislative process can be analysed in a multifaceted manner. These also form the basis for analysing which points of criticism were ultimately included in the final version of the Substitute Building Materials Ordinance and which objections remained unheard. Following on from this, this thesis analyses the foreseeable success of the implementation of the ordinance with regard to the aforementioned environmental policy conflict of objectives. Finally, the paper formulates further approaches that could promote the recyclability of the construction industry and increase the recycling rates of mineral construction and demolition waste.
