Abstract:
Supplements are not uncommon in the construction industry and can be accompanied by significant cost increases. Quality management of addenda is therefore crucial for the economic situation of a company. In past projects, Eiffage Infra-Ost GmbH repeatedly encountered difficulties in enforcing addenda. The analysis of five selected projects with particularly high losses from addenda revealed twelve recurring problems. Audit criteria and options for action were developed for these based on current case law and the legal principles of the German Civil Code (BGB) and the German Construction Contract Procedures (VOB/B). The examination of the criteria and conditions developed provides a basis for future projects, on which arguments can be made to the client in the event of disputed subcontracts. The elaborations were summarised in a guideline. This clearly sets out the court judgements and current legal situation to which the company's employees can refer when naming and justifying claims arising from supplements. By using the guidelines and regularly training employees on the subject of claims management, it will be possible to successfully enforce claims arising from supplements in the future.
