Flexible Childcare
During the Corona pandemic, students with child(ren) also have the opportunity to take advantage of TUD's flexible childcare service on an hourly basis (e.g. while taking exams) from January to September 2021. The childcare is provided in cooperation with the agency Wirbelwind.

Would you like to attend business appointments in the late afternoon or lectures at the weekend while at the same time knowing that your children are well looked after? You organise an event at TU Dresden and you would like to offer flexible childcare to your participants? TU Dresden supports you and offers its members of staff and, on request, participants of TU Dresden events the possibility to use the flexible childcare for children between the ages of 3 months and 12 years old within the city area of Dresden and on request for the surrounding area. The Service is provided by the Wirbelwind Agency Dresden.
In a few steps to the flexible childcare:
Flexible childcare includes a babysitting service, a pick up / drop off service and, on request, conference childcare.
- The babysitter service includes childcare in the parental home.
- The pick up / drop off service includes a caregiver who is accompanying the children from kindergarten or school to the parental home or vice versa by means of public transport or on foot. The children are not allowed to ride in the car of the caregiver / contractor.
- The conference childcare includes the supervision of the children before and during TU Dresden events such as conferences, lectures, training. A supervision in the premises of TU Dresden is excluded.
Folgende Hinweise bzw. Regeln sollten beachtet werden:
- Die erlassenen bzw. empfohlenen Hygiene- Vorschriften werden von den Mitarbeiter:innen der Agentur Wirbelwind gewährleistet, u.a. werden Mundschutz und Handschuhe getragen. Die Mitarbeiter:innen werden hierzu regelmäßig schriftlich belehrt und geschult.
- Hände waschen bleibt weiterhin oberstes Gebot! Dies gilt für die Betreuungspersonen und auch für Sie als Eltern und Ihre Kinder.
- Weiterhin bitten wir Sie als Eltern um Ihre Mitteilung an die Agentur Wirbelwind, sollten sich Symptome einer Corona- Infektion oder Verdachtsfälle im Familienumkreis zeigen. Selbstverständlich informiert Sie auch die Agentur, wenn dort ein Verdachtsfall auftritt.
Children aged between three months and twelve years of employees (with teaching commitments) and students of TU Dresdenas well as participants at TU events (upon request) can use the flexible childcare.
Flexible childcare can be used flexibly and according to your needs from Monday to Sunday between 6:00 and 22:00. Flexible childcare is not a substitute for childcare in the sense of the Sächsisches Gesetz zur Förderung von Kindern in Tageseinrichtungen (SächsKitaG) [Saxon Law on Day Care and Promotion Facilities for Children].
The care period for TU Dresden employees (with teaching commitments) per family is limited to fifteen hours of care per month.
Students of TU Dresden can use the service on an hourly basis (max. 5 hours per month), e.g. while taking exams.
The caregivers are employees, educational specialists or pedagogically trained carers working at an childcare agency. They have experience in childcare, partly also in the care of children who are restricted due to health issues. All caregivers have completed at least a babysitting course and a first aid course for newborns and toddlers and have a health certificate as well as a flawless "certificate of good conduct". The carers have sufficient English language skills, so that the supervision of international children is also guaranteed. Taking care of sick children is not possible.
Before the first day of care, a meeting of the caregiver with a custodial person and the child takes place, in order to get to know the child and discuss his/her habits and preferences. With repeated use of the flexible childcare, the contractor will endeavour to have your child be supervised by the same caregiver. Of course, using of flexible childcare is optinal.
TU Dresden bears the costs for the flexible childcare according to the conditions of cost reimbursement if, due to official appointments or events, special childcare is required and there is no suitable childcare to be found elsewhere. The assumption of the costs for flexible childcare is a financial advantage (Geldwerter Vorteil) (excluded students).
In order for TU Dresden to assume the costs for flexible childcare, the beneficiary of the childcare needs to submit the application for the assumption of costs to TU Dresden, Unit Diversity Management, coordination of family friendliness immediately after the childcare was provided. In this case, the service provider will settle the fees for the childcare directly with TU Dresden.

Financial advantage (Geldwerter Vorteil)?
The assumption of the costs for the flexible childcare is regarded (excluded students) as a benefit in kind, which is to be calculated at an hourly rate of 35.11 EUR, to be applied in accordance with local practice. In accordance with § 8 para. 2 EStG, the tax-law exemption limit for such financial benefits (also in combination with possible other financial benefits) is 50.00 EUR per month. The relevant department (Dienststelle) must report this financial advantage to the payroll office (Bezügestelle Dresden) as taxable salary for all TU Dresden members of staff whose expenses for flexible childcare were assumed. For this purpose, TU Dresden transmits the data required for reporting the financial advantage to the payroll office.
We ask students to check if the benefits of flexible childcare are to be registered as receipt in the declaration of income tax.
All users of the flexible childcare who are not members of staff of TU Dresden or students of TU Dresden are informed that they must report the financial advantage to the personnel administration of their own employers.

1. For what purpose will personal data be processed?

3. What is the legal basis for TU Dresden to process personal data?
Use of the service provided is entirely voluntary. In accordance with § 5 para. 2 no. 11 of the Act on the Autonomy of Institutions of Higher Education in the Free State of Saxony, the legislator has assigned TU Dresden the responsibility of taking into account in its decisions the social concerns of its members and associates. Hence the offer of flexible childcare. If you make use of this offer, personal data will be processed on the basis of § 3 of the Saxon Data Protection Implementation Act.
4. How long is personal data stored at TU Dresden?
The collected data shall be stored for a period of 6 years after the end of the financial year in which the childcare was provided. The storage is legally required for budgetary purposes (auditing) (see also § 147 Abgabenordnung).
5. Is personal data transmitted to third parties by TU Dresden?
Personal data will be transferred to the State Office of Finance for the purpose of crediting the granting of advantages [German: Vorteilsgewährung]. This office that manages salaries is responsible in this case. In order to clarify any discrepancies that may arise with regard to flexible childcare, in individual cases, data may also be transferred to the Wirbelwind Agency.
6. Which are the general rights of data subjects?
To claim the rights, you only need to notify the responsible person in text form (letter, email or fax).
a) Right of access to personal data (Art. 15 GDPR)
Data subjects shall have the right to obtain at any time information on the data processed relating to their person and the possible recipients of such data. They shall be entitled to a reply within one month of receipt of the request for information.
b) Right of rectification, deletion and restriction (Art. 16 - 18 GDPR)
Data subjects may at any time request TU Dresden to rectify or delete their personal data or to restrict processing.
c) Right to data portability (Art. 20 GDPR)
Data subjects may request that the responsible party send them their personal data in a machine-readable format. Alternatively, they may request the direct transfer of the personal data they provided to another responsible party, where possible.
d) Right of appeal (Art. 77 GDPR)
Data subjects can at any time contact TU Dresden's Data Protection Officer and, in the event of a complaint pursuant to Art. 77 DSGVO, the competent supervisory authority for data protection. The relevant supervisory authority is:
