Dear Sir or Madam,
please note (in view of the notification of several relevant cases by the Foreigners' Registration Office) that concrete offers and commitments to hire applicants may only be made after the hiring process has been fully reviewed in the ZUV. In this regard, I refer to the official channels to be followed (sending the formal application for employment signed by the head of the employment area via the dean / head of the central facility / department head to the ZUV, awaiting release from there after successful review). In order to prove the intention of employment to the foreigners authority / German mission abroad, sample employment contracts are issued by the Human Resources Department after checking the essential requirements for employment (in particular, duration, reason for time limit, confirmation of financing, qualification of the applicant, classification according to collective agreement).
If applicants are to be informed in advance of an intention to employ them (e.g. as a result of interviews based on a job advertisement), it must be clearly expressed that the selection decision and thus the desired employment are subject to review/confirmation by the ZUV and, if necessary, the approval of the staff council and other bodies. The chosen formulations must not give the impression, either for the applicant or for outsiders, that the hiring under certain conditions is already certain or that the execution of the corresponding contract is definitely to be expected. The assumption of any further obligations associated with this (e.g. guarantee of health insurance cover) must also not yet be bindingly promised.
This applies (beyond the possible consequences under employment law of an unauthorized promise of employment) in particular to letters that are intended for obtaining a residence title or can be used for this purpose. If promises made subsequently turn out to be untenable (e.g. due to unsecured financing or insufficient qualification of the applicant), both the author of the promise, his/her superior and the applicant himself/herself are threatened with severe sanctions (criminal offense pursuant to Section 95 (2) of the Residence Act11) for obtaining a residence title by fraud. Corresponding cases can be reported to the main customs office by the foreigners authority.
In the common interest, we therefore urgently request that the above information be observed. If you require any further information on this matter, please do not hesitate to contact me as your contact person for questions relating to residence law in D 2.
With best regards
Konstantin Derham
