Come2Data
As part of the BMBF-funded joint project Come2Data, a data competence center is to be created in Saxony for a comprehensive training and support offer for researchers on skills for data integration, data management, data analysis and data publication. To this end, a central point of contact will be established for all legal inquiries regarding the use and transfer of research data in a scientific context. Legal issues can arise throughout the entire process of generating, collecting, forwarding, processing, enriching, archiving and publishing digital research data, such as questions of legally compliant collection and use, attribution, access or publication. The main focus will be on issues relating to copyright, employment, service, contract, data protection and liability law.
During the implementation phase, the legal framework and the structural embedding of such a contact point will be examined. In particular, it should be clarified under which conditions the Legal Helpdesk can provide specific legal advice in addition to providing information and training and how such a service can be integrated into existing structures. This is particularly important because cross-organizational legal advice must comply with the requirements of the Legal Services Act (RDG). In addition, the liability framework for the employees involved must be clarified.
Secondly, a comprehensive catalog is to be developed in consultation with the stakeholders involved, which includes typical case constellations and related legal issues. Handouts and materials will then be developed for these case constellations and legal issues, which will serve as an aid to support first-level support after the implementation phase. Information and training events will also be designed.
Further objectives of the Legal Helpdesk are the curation of external information materials, assistance in the formulation of contract modules for research data management, the monitoring of ongoing legislative procedures and current rulings as well as advice on policy issues.
