Purpose of the processing of personal data

You would like to apply as part of a recruitment or appointment procedure at TU Dresden to fill a (junior) professorship or a position as junior research group leader with tenure track. The protection of your personal data is very important to us. The purpose of data collection and processing is the lawful examination of your application as part of the selection process, the preparation of a possible service or employment relationship or the implementation of organizational, personnel and social measures, in particular for the purposes of personnel planning and deployment. For this purpose, we store all the data you provide to us as part of your application. We collect further personal data on your person that is essential for the selection decision over the course of the multi-stage selection process. You will be informed separately by Directorate Personnel about the personal data to be collected that is necessary for establishing the service or employment relationship.

The collection and processing of your personal data is crucial for the lawfulness of the selection procedure to be carried out. The lack of relevant personal data in the application documents may result in your application not being considered for the job/position. If you request the deletion of your application data during the selection process, this will be regarded as a withdrawal of your application.

Who is responsible for data processing and to whom can data subjects turn?

What is the legal basis for the processing of personal data?

The legal basis for data collection and data processing for the aforementioned purposes is Art. 6 para. 1 subpara. 1 point (b) and (e), para. 2 and 3 GDPR, Art. 9 para. 2 point (b) and (h) GDPR, Art. 88 para. 1 GDPR in conjunction with Art. 6 para. 2 no. 5 Saxon Higher Education Act (SächsHSG) and Art. 11 para. 1 Saxon Data Protection Law (SächsDSDG).

The legal requirements for the selection procedure at TU Dresden are based in particular on Art. 33 para. 2 of the German Basic Law, the Constitution of the Free State of Saxony, the General Act on Equal Treatment, the Saxon Higher Education Act, budgetary law and the relevant university regulations (e.g. Fundamental Principles, Appointment Regulations, Tenure Track Regulations).

What personal data will be processed?

Your personal data contained in the application documents or, if applicable, obtained in the interview will be processed, in particular:

• Personal data (e.g. first and last name, date of birth, address, disability if applicable)
• Contact data (e.g. telephone number, mobile phone number, email address)
• Data on education as well as on professional and academic career (e.g. school-leaving qualifications, professional qualifications, studies, doctorate, habilitation, academic degree, position, institution/organization, area of responsibility, list of publications, list of third-party funding, list of teaching activities, teaching evaluations, certificates, evidence of further education and training, etc.)
• Any other qualifications (e.g. language skills, management and leadership experience)
• Application photo, if applicable

How long is personal data processed/stored?

The personal data of unsuccessful applicants collected during the selection procedure will be stored on the servers of TU Dresden for the duration of the selection procedure. This storage of information usually serves to safeguard the applicants' rights of objection for 6 months after commencement of employment. After this period has elapsed, it is deleted or destroyed in accordance with data protection regulations. The same applies if the application is withdrawn.

If your application is successful, your cover letter and documents will be included in your personnel file. You will be informed separately by Directorate Personnel about the regulations applicable to the handling of your personnel data, in particular with regard to the creation of personnel files (see section Purpose and Legal Basis).

Will personal data be transferred to third parties?

The personal data you provide will be made available to persons involved in the selection process. These are in particular members of the Appointment Committee, which is made up of representatives of TU Dresden and external persons, usually those with professorial duties, the Officer for the Protection of Women's Rights and Equal Opportunities, the Representative of Employees with disabilities and the Appointment Officer to be involved, if applicable, the secretary and guests of the Appointment Committee, external experts, the Rector, the Faculty Council or Academic Council of a Central Academic Unit with appointment rights, faculty and university administration, the Chancellor and, if applicable, the Extended University Executive Board, the Senate, the University Council and the Saxon State Ministry of Science, Culture and Tourism.

In the case of joint appointment procedures, your personal data will also be made accessible to the responsible commission members or commissions, committees and representatives of the respective cooperation partners.

In the event of legal disputes, the data will be transmitted to the responsible courts.

A data transfer / disclosure will only occur within TU Dresden, the administrative offices of the Saxon State Ministry for Science, Culture and Tourism as well as the State Office for Taxes and Finance if this is necessary and specified by law according to no. 3. A data transfer / disclosure to third parties will only occur if this is necessary according to no. 3 and for the fulfillment of a legal obligation (in this case, in particular, contracts with third-party funding partners, grant notifications - SAB/ESF, etc.) or if data transfer is to take place according to § 6 para. 1 sentence 2 SächsDSDG on the basis of a lawful request from a public body or if the data subject has consented to the data transfer / disclosure in particular cases.

Will personal data be published?

No, your personal data will not be published.

What general rights do data subjects have?

1) Right of access to personal data (Art. 15 GDPR)

You have the right to obtain information on the data processed concerning your person, as well as the possible recipients of this data, at any time. You are entitled to a reply within one month after the responsible party receives the request for information.

2) Right to rectification, erasure and restriction (Art. 16- 18 GDPR)

You may request that TU Dresden correct or erase your personal data and/or restrict its processing at any time.

3) Right to data portability (Art. 20 GDPR)

You may request that the responsible party send you your personal data in a machine-readable form. Alternatively, you can request the direct transfer of your personal data to a different responsible party, insofar as this is possible.

4) Right to object (Art. 21 GDPR)

You have the right to object at any time, on grounds relating to your particular situation, to the processing of personal data relating to you which is carried out on the basis of Art. 6 para. 1 subpara. 1 letter e GDPR, at any time.

5) Right to lodge a complaint (Art. 77 GDPR)

You can contact TU Dresden's Data Protection Officer (see above) at any time and, in the case of a complaint pursuant to Art. 77 GDPR, the responsible supervisory authority for data protection.

Please note: To claim your rights, it is sufficient that you notify the appointing office (see above) in writing (letter or email). However, rights can only be claimed if the processed data enables the identification of your person.
