EXPORT CONTROL

Contracts with persons from third countries
Due to current events, we would like to point out that an export control check must be carried out before contracts (here: all part-time contractual relationships) are drawn up with persons from third countries.  Please refer in particular to the current circular 2/2024 on this topic and to the TU Dresden website on export controls.

Subject unit 2.4 must check in the context of applications whether an export control check has been carried out by the applying structural unit and, if this is missing, reject applications if necessary.

Please observe the requirements of the Residence Act on remunerated contracts

The requirement for proof, collection and processing of data, has its basis in § 4a of the Residence Act (AufenthG):
“(5) Foreigners may only be employed or commissioned to perform other paid work or services if they possess a residence title and if there is no relevant ban or restriction. Foreigners not holding a residence title may only be employed under the terms of subsection (4).
Anyone employing a foreigner in the federal territory must

• check whether the requirements referred to in sentence 1 or 2 are met,
• keep a copy of the residence title, of the seasonal work permit or of the certificate confirming permission to remain pending the asylum decision or confirming suspension of deportation, in electronic or paper form for the duration of the employment.”

“(3) […] If a residence title was granted for the purpose of a specific employment, pursuing another economic activity is prohibited as long as and to the extent that the competent authority has not given its permission.”

Therefore, before an employment or other person-related contractual relationship involving work for TU Dresden (remunerated contracts) can be justified, it is necessary to request proof of identity from the contracting party.
For contracting parties who do not have German citizenship, a passport is the official document required for proof of identity (only the section of the passport that contains basic personal data, including citizenship and the passport’s expiry date).
In the case of foreign contracting parties who require a residence or work permit, a copy of these residence documents must also be requested. This applies to all contracting parties who are not EU/EEA citizens or who share this status and are not permitted to stay in Germany without a visa during the contract period, or who are not permitted to pursue the planned activity without a work permit.

When applying for a remunerated contract, the person placing the request must provide the necessary supporting documentation. 

If the supporting documents required for drafting the contract are not available or not submitted, the contract can only be prepared but not issued. In this case, contracting parties must present themselves to Directorate Personnel upon arrival and provide the supporting documentation.

This procedure is only mandatory for remunerated contracts. Alternatively, an unremunerated contract may be offered to reimburse travel expenses incurred by the participant, pursuant to the Saxon Travel Expenses Act. Unremunerated contracts do not require the proof of identity mentioned above.
