Discrimination against parents and carers at work
With the entry into force of the Act on the Implementation of the so-called "Caregiver Directive" (EU 2019/1158) on 24 December 2022, the tasks of the Anti-Discrimination Agency, which are regulated in Section 27 of the General Equal Treatment Act (AGG), were expanded.
With the entry into force of the law transposing the so-called "Caregiver Directive" (EU 2019/1158) on 24 December 2022, the tasks of the anti-discrimination body, which are regulated in Section 27 of the General Equal Treatment Act (AGG), have been expanded. The directive establishes individual rights with regard to
- the time off work for fathers or equivalent second parents on the occasion of the birth of a child for the purpose of care and nursing,
- leave from work for parents on the occasion of the birth or adoption of a child for the purpose of caring for that child,
- leave from work for employees to care for or support a dependent person or a person living in the same household as the employee who is dependent on substantial care or support for serious medical reasons; and
- flexible working arrangements for workers who are parents or carers.
Article 11 of the Directive prohibits persons from being treated less favourably if they make use of these rights. For more information on the Caregiver Directive, click here
