Additional leave
The paid additional leave for people with disabilities in the extent of a working week per leave year (Article 125 SGB IX) is only granted from a disability rate of 50 upwards, i.e. this entitlement does not exist for equated persons.
If the regular weekly working time is distributed over more or less than 5 working days per calendar week, the above-mentioned special leave is increased or decreased accordingly. If the above-mentioned holiday begins or ends during the current holiday year, only a pro rata claim arises (one twelfth for each full calendar month). There is no retroactive entitlement to the above-mentioned supplementary leave.
The above-mentioned supplementary leave is added to the collectively bargained or statutory leave. Consequently, it cannot be reduced due to other leave entitlements. The "specific threshold" as defined in Article 49 TV-L does not apply.
