Rules and Regulations
You agree to these rules and regulations with the signed application requesting backup services.
The Following rules and regulations are recognized as soon as one logs onto the centralized backup service.
- The general usage rules and regulations of ZIH .
- The ZIH will be informed of the name of responsible backup administrators. If they leave or change jobs, or for other reasons cannot be reached, the new manager or a representative must inform the ZIH (preferably before the predecessor leaves). Informaton will only be given to the responsible or authorized administrator.
- If after intensive efforts to identify and contact the manager or person responsible, we reserve the right, when appropriate, to delete this data.
- Promptly notify the ZIH when a client no longer requires the backup service, so that the data is deleted and the resources can be opened up again.
- If, without known reason, 180 days pass without activity or saving, we reserve the right after consultation with the person in charge, to delete the corresponding data.
- A competent administrator must always monitor the success of the backup and the secured amount of space. We recommend daily status e-mails to be used.
Additionally, there is the following license agreement between the user (represented by the undersigned manager) of the software products (TSM), and Dresden University of Technology, represented by the ZIH.
Licensing Agreement
- The TU Dresden is a licensee; the user receives only usage rights.
- This applies also to all acquired software products and the general license terms, which may be obtained on the websites of the manufacturer or the ZIH.
- The user is entitled to use only software that is approved (and ordered) by the ZIH. The user may use the software for work in teaching and research, or within the field of responsibility on the computers within the TU Dresden. An approval for private or commercial use is hereby not granted, unless the manufacturer expressly authorizes such use in the form of a contract or license agreement. .
- The user is furthermore entitled to create backup and archive copies of the software under the license terms. The number of backup copies may not exceed the number of licenses purchased.
- The user receives the indefinite or temporary usage rights, depending on the type of software purchase. The usage is time-limited, so after this period of use, the user is liable to remove and destroy the backup copies without being prompted by the ZIH.
- If the user stops the employment relationship with the University, he must name a successor, in accordance with the Head of Department, in writing. If not, the usage rights expire. No rates, even prorated rates will be refunded. All submitted documents, data carriers, etc. are to be returned as well as prepared copies of the program.
- The user may not forward, give or sell the software to third parties. The user must take all precautions to protect the Software from unauthorized use.
- The ZIH makes no guarantee for the functional correctness of software.
- Warranty claims within the agreed in the license agreement, for example the warranty period, are to be reported to the ZIH immediately, so that appropriate action can be taken.
- The user is liable to the Licensee and/or the manufacturer for all damage arising from culpable non-compliance with all license terms.
- If the user culpably violates the license conditions, the ZIH is entitled to terminate the software product immediately with no refund.
- The user is legally obligated not to incur any additional costs and to comply with the relevant notice periods.
- The user receives, with the software, a registration document. It will be submitted when the product is being delivered via FTP. The registration document confirms the legality of software use. In case of damage, the registration document can be submitted to the ZIH, and network access wil be granted again.
- The ZIH performs the appropriate software ordering online. Based on the registration documents that contain the prices of software products, the user is then in the position to check the accuracy of transfer.
- If the user raises no objections within the next 4 weeks (date of outgoing e-mail in ZIH), this is considered acknowledgement from the user of the receipt of requested software overleaf.
- The invalidity of any or one of the above clauses shall not affect the conditions of the remaining terms of license. Verbal agreements are null and void.
